‘Nothing Wrong In Seeking Regime Change’: Neha Bora In Delhi HC; Verdict On AISA Chief’s Plea Today

  • October 23, 2026

The Delhi High Court witnessed intense legal arguments over the boundaries of democratic dissent during a hearing on a plea filed by All India Students’ Association president Neha Bora. Challenging a Delhi Police notice directing her to execute a peace bond of ten thousand rupees, Bora’s counsel argued that seeking regime change is fundamentally lawful in a vibrant democracy.

The hearing saw extended debates on constitutional freedoms, civil liberties, and the validity of preventive legal notices issued against student activists.

Clash Between Constitutional Rights and Law Enforcement
Appearing for the student leader, the defence counsel asserted that calling for political change or expressing dissatisfaction with the government falls well within the fundamental rights guaranteed under Articles 19 and 21 of the Constitution. The defence argued that peaceful assemblies and public demonstrations—including hoisting the national flag—do not constitute unlawful acts requiring preventive peace bonds.

Countering these submissions, Additional Solicitor General Chetan Sharma, representing the Delhi Police, argued that political transition in a constitutional setup must occur exclusively through the electoral ballot rather than public disruptions. Law enforcement authorities maintained that the notice was issued after evaluating repeated violations of prohibitory orders across key central Delhi locations.

Court Raises Stigma Concerns as Order Reserved

During the lengthy proceedings, the court raised pertinent observations regarding the potential stigma associated with preventive notices that require citizens to give assurances of good behaviour. The bench flagged concerns over whether such administrative actions prematurely brand individuals before any formal judicial finding.
