FIT student dead after being drugged, raped in her NYC dorm: prosecutor

  • October 16, 2026

A New York City teen is accused of drugging two Manhattan college students with fentanyl and then raping one in her dorm room while she was unconscious from the dangerous drug that ultimately killed her, according to a “sick and twisted” new indictment.

Bronx native Moises Freire, 19, brought fentanyl he claimed was cocaine to two Fashion Institute of Technology students at an undergraduate residence hall on March 18, a newly unsealed indictment from the US Attorney’s Office alleges.

Freire, who was not an FIT student, reassured the women that he was providing cocaine from Mexico and insisted it did not contain fentanyl, which he described as “poison,” the indictment alleges.

Moises Freire, 19, was charged with federal crimes after allegedly giving fentanyl that killed an FIT student as he raped the woman in her dorm room after she fell unconscious.

After convincing the students to take the illegal drug in their dorm, both students immediately lost consciousness and suffered from acute fentanyl poisoning, prosecutors said.

Freire, who did not consume any of the fentanyl, then raped one of the students while the other lay unconscious several feet away in the single-room dorm, according to the documents.

The teen allegedly waited about 45 minutes to contact campus security. During that time, he texted photos of the unconscious victims to friends — including the woman he allegedly raped, who was naked below the waist.

He initially told campus security that the women were unconscious because they simply had too much to drink, the documents said.

Campus security determined the women were suffering from acute fentanyl intoxication and administered emergency services and Narcan before they were rushed to the hospital, prosecutors said.

The woman who was raped never regained consciousness at the hospital and died several days later on March 21, the indictment said.

The other student eventually regained consciousness and was discharged from the hospital.

Before he met up with the women, Freire had told Brian Peralta Cabrera, 18, that he needed drugs that “would last the entire night,” and that if they were strong enough to get the students addicted, it would be a “win-win situation,” the court documents say.

Freire and Cabrera, of Queens, were each charged with one count of conspiracy to distribute a controlled substance resulting in death and serious bodily injury — which carries a mandatory minimum sentence of 20 years in prison and a maximum sentence of life in prison.

Freire was also slapped with distribution of a controlled substance resulting in death and serious bodily injury, as well as distribution of a controlled substance with the intent to commit rape.

“The allegations in this case are beyond disturbing and include a cruel deception and unimaginable assault,” Drug Enforcement Administration New York Task Force Division Special Agent in Charge Christopher Roberts said in a press release.

“College should be a place where young people can learn, grow, and pursue their dreams, not a place where predators exploit their vulnerability. Every student deserves to feel safe, whether walking across campus, sitting in a classroom, or inside their own dorm room,” he added.

Police Commissioner Jessica Tisch called the actions of Freire and Cabrera “truly unconscionable” and “as sick and twisted as they come.”

“As alleged in the indictment, the two defendants supplied the fentanyl that killed one young woman and nearly killed another,” Tisch said.
